The following tools on the website process input:

Company Formation Assistant: legal form, industry, activity description, registered office/domicile, basic founder details (first/last name, position, nationality, residence), Lex Koller-relevant data, contact information
Business financing agent: company data (industry, turnover, employees, EBITDA), financing requirements, banking relationship, contact information
Contact forms and newsletter sign-up: the respective fields provided

This data is used exclusively to process your enquiry and is transmitted securely via Netlify Forms (hosting provider, see Section 5).

We do not collect any particularly sensitive personal data (e.g. health data, political views) and do not engage in automated profiling within the meaning of Art. 21 GDPR.

4. Legal Basis

The processing of your personal data is based on:

Contract performance — to the extent that the data is necessary to provide our services
Consent — for voluntary contact via the form
Legitimate interests — for the secure operation of the website
Legal obligation — e.g. retention duties under the Swiss Code of Obligations

5. Data Disclosure and Processors

We only share your data when:

You have explicitly consented (e.g. forwarding to a notary, accounting partner, bank or succession advisor)
It is necessary for contract performance (e.g. partner companies for bookkeeping, mortgages, business valuation)
A legal obligation exists

Typical recipients in the course of our mandates: notaries, commercial registries, cantonal tax authorities, social security agencies (SVA), pension funds, accounting and fiduciary partners, banks and lenders (in financing mandates), auditors and lawyers (in SME succession transactions), domicile location partners.

Technical processors:

Netlify (hosting & forms, USA/EU) — website hosting and processing of form submissions
Calendly (USA/EU) — online appointment booking for initial consultations
Google Fonts — font delivery
Unsplash — image CDN for editorial content

All contracted partners are bound by data protection obligations (within the EU/EFTA via GDPR-compliant data processing agreements; for US providers via standard contractual clauses or equivalent safeguards). We do not pass on data to third parties for advertising purposes.

6. Retention Period

Contact enquiries: 2 years after completion of processing
Contract data: 10 years (statutory retention obligation under the Swiss Code of Obligations)
Website logs: 30 days (anonymised)

7. Your Rights

Under the Swiss FADP, you have the following rights:

Right of access — to know what data we hold about you
Right of rectification — to correct inaccurate data
Right of erasure — to delete your data, unless a retention obligation applies
Right to object — to object to data processing
Right to data portability — to receive your data in a common format
